Terms & Conditions for AkikoPay

This End User Agreement (the "Agreement") is made between you (the "User" or "You") and Akiko Global Services Limited (hereinafter referred to as "AkikoPay"), a Public Limited company having its registered office at 11th Floor, Off. No. 8, Vishwadeep Building, 4-D, West, District Centre, Janakpuri, New Delhi, Delhi – 110058 ("AkikoPay", "Us" or "We", which term shall include its successors and permitted assigns).

The User and AkikoPay shall be collectively referred to as the "Parties" and individually as a "Party".

Data Handling

Information Collection, Use & Confidentiality

AkikoPay shall access your Credit Information as your authorised representative and shall use the Credit Information solely for the limited End Use Purpose. We shall not aggregate, retain, store, copy, reproduce, republish, upload, post, transmit, sell or rent the Credit Information to any other person.

1.The Parties agree to protect and keep confidential the Credit Information both online and offline.

2.The Credit Information shared by you, or received by us on your behalf, shall be destroyed, purged and erased promptly within 1 (one) Business Day upon completion of the transaction or End Use Purpose for which the Credit Information report was procured.

Jurisdiction

Governing Law & Jurisdiction

The relationship between you and AkikoPay shall be governed by the laws of India. All claims or disputes arising therefrom shall be subject to the exclusive jurisdiction of the courts of Mumbai.

Any legal dispute arising from your use of AkikoPay shall be resolved exclusively before the courts located in Mumbai, India. By using our platform, you waive any objection to the exercise of jurisdiction over you by such courts.

Glossary

Key Definitions

Capitalised terms used herein but not defined elsewhere shall have the following meanings:

Business DayA day (other than a public holiday) on which banks are open for general business in Mumbai.

Credit Information ReportThe credit information, scores, aggregates, variables, inferences or reports generated by Experian.

Credit ScoreThe score mentioned on the Credit Information Report, computed by Experian.

CICRAThe Credit Information Companies (Regulation) Act, 2005 read with the Credit Information Companies Rules, 2006 and the Credit Information Companies Regulations, 2006.

End Use PurposeThe purpose of availing financial products from lenders pursuant to the Individual Consumer Consent.

AgreementThis End User Agreement between you (the User) and Akiko Global Services Limited (AkikoPay).

Experian HighMark — Credit Score Terms of Use

In connection with the submission of the application for your credit information ("Consumer Credit Information") offered by Experian HighMark Credit Information Services Pvt. Ltd. ("CIC") through Akiko Global Services Limited (referred to as the "Company") and the delivery of the Consumer Credit Information to the Company, you hereby acknowledge and agree to the following terms.

This consent shall be valid for a maximum period of 6 months or until the credit information is no longer needed, or until you withdraw your consent at any time by informing the Company — whichever is earlier.

Detailed Terms

HighMark Consent Clauses

1.The Company is my lawfully appointed agent and has agreed to act as my agent to obtain my Credit Information Report and Credit Score from Experian HighMark for the purpose of credit information and not for any other purposes.

2.This consent shall be valid for a maximum of 6 months or until the purpose is fulfilled, or I withdraw consent at any time by informing the Company — whichever is earlier.

3.I further authorise the Company to share my personal information/details with CICs to procure my Credit Information on a monthly frequency and use the same to provide the said service.

4.I confirm that this consent is given of my free will and not due to any solicitation by any person or entity.

5.I hereby expressly grant unconditional consent to, and direct, CIC to deliver and/or transfer my Consumer Credit Information to the Company on my behalf.

6.I shall not hold CIC responsible or liable for any loss, claim, liability, or damage of any kind resulting from: (a) delivery of my Consumer Credit Information to the Company; (b) any use, modification or disclosure by the Company; or (c) any breach of confidentiality.

7.I acknowledge and accept that CIC has not made any promises or representations to induce me to provide my Consumer Credit Information, and the implementation of the Agreement is solely the responsibility of the Company.

8.I agree that I may be required to record my consent electronically or physically. By clicking "I Accept" I am providing written instructions to the Company authorising it to obtain my Consumer Credit Information from Experian HighMark.

9.In order to deliver the product to me, I hereby authorise the Company to obtain my Consumer Credit Information from CIC.

10.By submitting this registration form, I understand that I am providing express written instructions for the Company to request and receive a copy of my consumer credit report and score from CIC.

11.I understand that the product is provided on an "as-is", "as available" basis and CIC expressly disclaims all warranties, including the warranties of merchantability and fitness for a particular purpose.

12.I irrevocably, unconditionally and entirely release, waive and forever discharge CIC, its officers, directors, employees, agents, licensees, affiliates, successors and assigns from any and all liabilities with respect to the delivery of my Consumer Credit Information.

13.I agree that the terms of this confirmation shall be governed by the laws of India and shall be subject to the exclusive jurisdiction of the courts located in Mumbai.
